1. Acceptance of Terms

By accessing or using the Element Wing Tsun website, submitting any inquiry form, enrolling in classes, or participating in any programs offered by Element Wing Tsun ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.

2. Services Offered

Element Wing Tsun offers martial arts instruction in Wing Tsun Kung Fu for adults and children at our location in Harrington Park, New Jersey. Our services include:

• In-person group classes for adults and children
• Free trial classes for new students
• Private and semi-private instruction
• Ongoing membership programs
• Promotional and informational communications via email and SMS

3. Free Trial Classes

We offer a complimentary free trial class to new students with no obligation or commitment required. By requesting a free trial class through our website or Facebook Lead Ad form, you agree to:

• Provide accurate contact information
• Receive follow-up communications from Element Wing Tsun regarding your trial and membership options
• Arrive on time and follow all school rules and instructor guidance during your visit

Free trial classes are available to individuals 18 years of age or older, or to minors accompanied by a parent or legal guardian. Element Wing Tsun reserves the right to decline participation at its discretion.

4. Assumption of Risk & Physical Activity Waiver

You agree to:

• Inform your instructor of any pre-existing medical conditions, injuries, or physical limitations before participating
• Consult a licensed physician before beginning any new physical training program if you have health concerns
• Follow all safety guidelines provided by Element Wing Tsun instructors
• Train within your personal physical limits and communicate discomfort or injury immediately

Element Wing Tsun, its instructors, agents, and affiliates shall not be liable for any injury, loss, or damage sustained during participation in classes or on school premises, except where such injury results directly from gross negligence or willful misconduct.

5. Membership & Payment Terms

Membership enrollment and payment terms will be presented at the time of sign-up. General terms include:

• Monthly membership fees are due on the agreed billing date each month
• Memberships may be paused or cancelled with written notice as specified in your enrollment agreement
• No refunds will be issued for unused class time within a paid membership period unless otherwise agreed in writing
• Returned or failed payments may result in a service fee and temporary suspension of membership privileges

Specific pricing, cancellation policies, and contract terms are outlined in the individual membership agreement provided at enrollment.

6. Code of Conduct

All students, parents, and guests are expected to conduct themselves with respect and professionalism at all times. The following behaviors are grounds for immediate removal from class or termination of membership without refund:

• Verbal or physical aggression toward instructors, students, or guests
• Use of techniques learned at Element Wing Tsun to harm others outside of lawful self-defense situations
• Harassment, discrimination, or bullying of any kind
• Arriving under the influence of alcohol or controlled substances
• Destruction or theft of property

7. Communications & SMS Opt-In

By submitting your contact information through our website or Facebook Lead Ad form, you consent to receive emails and SMS text messages from Element Wing Tsun. These communications may include class reminders, follow-up messages, promotional offers, and scheduling updates.

No mobile opt-in data or consent information will be shared with any third parties.

You can cancel the SMS service at any time. Just text "STOP" to (201) 949-7878. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive up to 4–6 messages per week depending on your enrollment stage. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

8. Intellectual Property

All content on the Element Wing Tsun website — including text, images, logos, videos, and course materials — is the property of Element Wing Tsun or its content licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

9. Photography & Media Release

Element Wing Tsun may photograph or record classes for instructional and promotional purposes. By participating in classes, you grant Element Wing Tsun a non-exclusive, royalty-free license to use your likeness in such materials. If you do not wish to be photographed or recorded, please notify us in writing prior to your first class.

10. Limitation of Liability

To the fullest extent permitted by law, Element Wing Tsun shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, website, or facilities. Our total liability to you for any claim shall not exceed the total amount paid by you to Element Wing Tsun in the three months preceding the claim.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bergen County, New Jersey.
